As there was a difference of opinion between their Lordships the Chief Justice and Mr. Justice Carnduff in respect of five of the Appellants , viz, Krishna Jiban Sanyal, Sailendra Nath Bose, Indra N. Nundy, Birendra Chandra Sen and Sushil Krishna Sen, their cases were referred for decision before a third Judge of the Hon'ble High Court , Sir Richard Harrington, Bart. The Hearing

of the Reference commenced on the 3rd January 1910 and fully occupied the time of the Court for over a month. The two leading Counsel on the opposite sides Messrs. E. Norton and C. R. Das could not appear owing to other engagements. The newly arrived Advocate-General Mr. G. H. B. Kenrick, k.c., appeared for the Crown.
